Terms and Conditions

These Terms & Conditions (“Terms”) govern your access to and use of PHPHR, including the PHPHR website, Cloud HRMS services, and the PHPHR Open-Source Edition.

By using PHPHR, you agree to these Terms. If you do not agree, please discontinue use of our services and site.

1. Definitions

  • “PHPHR”, “we”, “our”, “us” refers to the PHPHR software and service provider.
  • “User”, “Customer”, “you” refers to any person or organization accessing or using PHPHR.
  • “Cloud HRMS” refers to the hosted, subscription-based version of PHPHR.
  • “Open-Source Edition” refers to the downloadable, self-hosted, limited-module version.
  • “Services” include our website, software, cloud platform, documentation, and support.

2. Use of Services

You agree to use PHPHR only for lawful and authorized purposes. You must not:

  • Attempt to disrupt, hack, or interfere with the platform
  • Upload harmful files, viruses, or malicious code
  • Reverse-engineer or attempt to copy Cloud HRMS
  • Use the platform for fraudulent or illegal activity

3. Open-Source Edition License

The PHPHR Open-Source Edition includes limited modules and is licensed for self-hosted use only.

You may:

  • Download and install the software
  • Modify source code for internal business use

You may NOT:

  • Sell, resell, or offer Open-Source PHPHR as a hosted SaaS product
  • Claim ownership of the brand, trademarks, or software
  • Redistribute modified versions publicly

You are fully responsible for:

  • Data security
  • Server management
  • Backups
  • Installation and maintenance

PHPHR does not store or access your self-hosted data.

4. Cloud HRMS Subscription

The Cloud HRMS is provided on a paid subscription basis.

By subscribing, you agree to:

  • Pay all applicable fees
  • Maintain accurate billing information
  • Not exceed your plan limits
  • Keep your login credentials secure

Non-payment may result in account suspension or termination.

5. Data Ownership & Responsibility

5.1 Your Data

All HR data you upload (employees, attendance, payroll, documents, etc.) remains your property.

5.2 Cloud HRMS Users

  • Your data is stored securely on PHPHR-managed servers.
  • Upon cancellation, your data may be permanently deleted within 15 days, unless you request early deletion.

5.3 Open-Source Users

All data remains on your server. PHPHR has no access to your database or files.

6. Backups

Cloud HRMS

We perform automated backups at regular intervals. However, PHPHR is not liable for data loss resulting from external factors, system failures, or force majeure events.

Open-Source Edition

You are solely responsible for your backup processes and data protection.

7. Support & Updates

Cloud HRMS

Your subscription includes:

  • Regular updates
  • Bug fixes
  • Security patches
  • Customer support (based on your plan)

Open-Source Edition

  • Limited support
  • Manual updates
  • You are responsible for installation and compatibility

8. Intellectual Property

All branding, website content, Cloud HRMS code, designs, and trademarks belong to PHPHR.

You may not copy, distribute, or reproduce any part of our Cloud HRMS without written permission.

Open-Source Edition code is provided for internal use only.

9. Limitation of Liability

To the maximum extent permitted by law:

  • PHPHR is not responsible for loss of data, revenue, business, or profits
  • PHPHR is not liable for outages, interruptions, or technical failures
  • PHPHR is not responsible for security vulnerabilities in self-hosted Open-Source installations
  • All use of PHPHR is at your own risk

10. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or harmful activities
  • Misuse the software or services
  • Fail to pay subscription fees

You may cancel your subscription at any time.

11. Refund Policy

PHPHR does not offer refunds for any subscription, setup, or service fees. Before purchasing, users are provided with a live demo, and the software you receive will function in the same manner as demonstrated. Once your account is created and setup work has begun or completed, the service is considered delivered, and therefore no refunds will be issued under any circumstances.
All purchases are final and non-refundable.

12. Third-Party Integrations

PHPHR may integrate with external services. We are not responsible for the availability or behavior of third-party systems.

13. Governing Law

These Terms are governed by the laws of Delhi, India. All disputes will be handled by the courts in Tis Hazari Court.

14. Working Hours & Support Response Time

Our official working hours are:

Monday to Friday — 9:00 AM to 6:00 PM IST

Response Time Commitment:

  • Standard Users
    • Response within 24 hours during working days
    • Response within 48 hours on weekends
  • Premium Customers
    • Response within 5 minutes during working hours

15. Modifications to Terms

We may update or modify these Terms and the Privacy Policy at any time, with or without notice.

Any change becomes effective immediately upon public posting on our website.

Your continued use of PHPHR after updates signifies your acceptance of the revised Terms.
